Here’s your end-of-year Business Legal Checklist!


LLC/Corp. Compliance:

• Make sure your records are up to date and accessible. For your LLC, this means reviewing your Articles of Organization, Operating Agreement, and state filings.
• Make sure your FTB fees are paid. If these aren’t paid, your business can be declared “INACTIVE.” A business that has been administratively inactivated cannot carry on any business activities and it is not protecting you!
• Make sure your contracts and agreements are all signed on behalf of the LLC.
• Make sure your business license gets renewed.

Trademark/Copyright:

• Apply for state or federal trademark protection of your business name/logo. The process is currently taking a minimum, of 1 year +.
• If you already have a trademark registered, make sure you have a proper monitoring system in place for due diligence.
• Created new material? Seek to protect it under copyright registration.

Contracts:

• Review your contracts and make sure they’re up to date with current laws, and valid.
• No contracts? This is a great time to implement them! Review all business relationships.

Website:

• Review your Privacy Policy and Terms + Conditions to make sure they’re up to date.
• Is your website ADA-compliant? If not, start looking at how to comply.

Hiring:

• If you’re looking to hire, make sure you understand if your new hire is a contractor or employee (you don’t get to dictate this, the law does).
